Sensor requirement

Which is the best sensor to detect static human presence. It needs to sense if a rider is wearing a helmet or not(for motorbike).
 
I would guess a camera with (very good) object recognition software.

Sir...The sensor has to be placed up close to the subject...almost touching the subject.
 
So thought that we can't place the camera is that position.
When you say "detect a person", what else may be present that you don't want to detect (a small dog, a large dog, an ape, shadows of people, a humanoid robot...)?

Or are you only checking if a person is present or not present with no interfering objects possible?

What kind of area do you want to sense (Entry door to a room, a computer chair, an entire room, a park or forest)?

If that is your requirement, then have a look at a capacitive proximity sensor.
