Loading a file into a jtag programmer fail

Having messed for 2 hours with my pickit3 I decided to try my jtag programmer.

The programmer connects and erases the chip ok, however when I try and load the hex file the software comes up file error at line 211, after much messing I found that that line is the config for the chip (the chip in the socket is the same as the one selected), if I delete the config line the file loads and the jtag programmer burns the chip ok, obviously the code isnt gonna run as the fuses will be wrong, and seeing as I didnt write the code I dont know what they all should be, allthough some can be worked out.

Is there something I can do to make the programmer happy.
I dont think the hex is corrupted as mplab loads it ok.
