433MHz or 315MHz rf?

Use the one which complies with your local radio regulations:

USA - 315Mhz

Europe - 434Mhz

Sri Lanka - I dont know, look on the website of the govenment radio regulatory authority

anyway is there any advantage of one frequency over other if we dont have any legal problem about frequency?

No, there should not be much difference between them.

basically there is not too much difference between the two, just some regulations, the 433.92MHz and 868.35MHz version is designed for use in the European Union while the 315MHz and 418MHz versions are not legal for use in EU. The performance is not quite different between the two.

It is easier to get a better transmit and receive antennas (closer to half-wavelength) at 433MHz.
